1. Introduction and Agreement

These Terms of Service ("Terms") govern your access to and use of the Ace It certification exam preparation platform, including the website, APIs, and all related services (collectively, the "Service"). "Ace It", "we", "us", and "our" refer to the operator of the Service. "You" refers to the individual account holder.

By creating an account, checking the agreement box during registration, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Account Terms

• You must be at least 18 years old to create an account and use the Service. The Service is not directed to, and we do not knowingly collect personal information from, children under 18.
• You must provide accurate, current, and complete information when creating your account, and keep that information up to date.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at click to reveal email if you suspect unauthorized access.
• One person may maintain only one account. You may not share, sell, rent, transfer, or loan your account or credentials to anyone else.
• We may require email verification before you can use certain features.

3. Free Tier

The free tier provides access to 5 randomly selected questions per quiz on any vendor certification we list. Free tier access does not include score tracking, quiz resume, or access to the full question pool for vendor certifications. The free tier is offered as-is and may be modified, limited, or discontinued at any time without liability to you.

4. Mastery Badge Topics

We also publish a separate catalogue of Mastery Badge topics — free, non-vendor study tracks aimed at core skills rather than a specific vendor exam. Signed-in accounts get unlimited access to the full question pool, score tracking, and quiz resume for these topics at no charge.

• Passing a Mastery Badge session generates a personalized Mastery Badge PDF that we deliver to the email on file for your account. Additional ways to access or share earned badges may be introduced over time.
• A Mastery Badge is a record of the practice session on our Service. It is not a professional certification, is not accredited, and is not endorsed by any certification body or employer.
• Mastery Badge PDFs and any related content we provide are for personal use only. You may not alter, misrepresent, resell, or use them to falsely claim a credential you have not earned.
• We may add, retire, rename, or change the format of Mastery Badge topics and PDFs at any time without liability to you. Because no payment is made for a Mastery Badge, no refunds apply.

5. Single Certification Purchases

• A single certification purchase is a one-time payment that grants you access to the full question pool for one certification for 6 months from the date of purchase.
• Prices are set per certification and are displayed on the pricing page and on each certification's page before checkout. Different certifications may carry different prices, and we may change the price of any certification at any time; the price you pay is the price shown at checkout.
• From time to time we may offer a specific certification at no cost. Claiming a no-cost certification still grants the same 6-month access under these Terms, but no payment is exchanged and no refund is possible.
• Access is non-transferable and limited to the purchasing account only.
• Access expires automatically after 6 months. There is no obligation on either side to renew.
• This is a purchase of digital goods. Once you begin using the paid access — for example, by starting a tracked quiz session for that certification — the purchase is considered used and consumed. Trying the free-tier sample (5 questions) for the same certification does not, on its own, count as using the paid access.

6. Subscription Plans

• We currently offer Basic and Pro subscription tiers. Each is available on a monthly or annual billing cycle, selected at checkout, and grants access to the full question pool across all vendor certifications for as long as the subscription remains active.
• Subscriptions renew automatically at the then-current price until cancelled.
• You may cancel your subscription at any time from your billing page. Cancellation takes effect at the end of your current billing period; access continues until then.
• No partial refunds are provided for unused portions of a billing period.
• We may change subscription pricing or the features included in each tier with at least 30 days' notice sent to the email on file. Continued use after the change takes effect constitutes acceptance of the new price and terms.
• Promotional subscriptions granted via a promo code do not auto-renew and revert to the free tier when the promotional period ends.

7. Refund Policy

• Single certification purchases: You may request a refund within 7 days of purchase, provided you have not yet used the paid access for that certification. Using the paid access means starting a tracked quiz session against the certification (for example, an untimed practice or timed exam-mode session on the full question pool). Free-tier sample sessions (5 randomly selected questions) do not, on their own, disqualify a refund. If you already had paid access to the certification through an active subscription or an earlier purchase and used it to practice the certification, that prior paid usage will also disqualify a refund. Submit the request from your billing page or email click to reveal email. Approved refunds are issued to the original payment method.
• Free (no-cost) certifications: Certifications offered at no cost cannot be refunded, because no payment was made.
• Mastery Badge topics: Not eligible for refunds — they are free.
• Subscriptions: No refunds are provided for subscription payments. You may cancel at any time to prevent future charges.
• Promotional subscriptions: Not eligible for cash refunds (no payment was made).
• Where applicable mandatory consumer-protection law requires additional rights (for example, the EU/UK right of withdrawal), those statutory rights apply in addition to the above and are not limited by this policy.

8. Acceptable Use

You agree not to, and not to help anyone else:

• Copy, distribute, publish, mirror, scrape, post, or publicly display any questions, answers, explanations, or other content from the Service.
• Use the Service, or content obtained from it, to create, train, fine-tune, or evaluate any machine-learning model, dataset, or competing product.
• Share your account credentials or allow multiple people to use a single account.
• Circumvent, disable, or interfere with access controls, rate limits, security features, or any other technical measure.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by applicable law.
• Use automated means (bots, scrapers, headless browsers) to access the Service, except for well-behaved search-engine crawlers on pages we make publicly crawlable.
• Upload or submit content that is unlawful, infringing, defamatory, harassing, or contains malware.
• Use the Service to violate any law, regulation, or third-party right.

Violation of this section may result in immediate suspension or termination of your account without refund.

9. Intellectual Property

The Service and all content made available through it — including questions, answer explanations, study guides, text, graphics, logos, and software — are owned by Ace It or our licensors and are protected by copyright, trademark, and other intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own exam preparation. All rights not expressly granted are reserved. Names of certifications, exams, and third-party trademarks referenced in the Service are the property of their respective owners and are used for identification purposes only; Ace It is not affiliated with, endorsed by, or sponsored by any certification body unless explicitly stated.

Feedback: If you send us suggestions or feedback about the Service, you grant us a royalty-free, perpetual, irrevocable licence to use it without restriction.

10. Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a written notice to click to reveal email including: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the allegedly infringing material and its location on the Service; (iv) your contact information; (v) a statement of good-faith belief that the use is not authorized; and (vi) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the copyright owner's behalf. We may remove content we believe in good faith is infringing and terminate repeat infringers.

11. Suspension and Termination

• By you: You may stop using the Service and request account deletion at any time by emailing click to reveal email.
• By us: We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service, other users, or third parties.
• On termination, your licence to use the Service ends immediately. Sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
• We are not obligated to retain your account data after termination and may delete it in accordance with our Privacy Policy.

12. Disclaimers

The Service is provided for exam preparation purposes only. Ace It is an independent study tool; we do not administer certification exams and are not affiliated with any certification body unless explicitly stated. We make no guarantee that using the Service will result in passing any certification exam, and we are not responsible for exam fees, travel costs, missed appointments, or any other expenses you incur.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or error-free operation. Some jurisdictions do not allow exclusion of implied warranties, so parts of this disclaimer may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law, Ace It and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or exam outcomes, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law (for example, for fraud, gross negligence, or death or personal injury caused by negligence).

14. Indemnification

You agree to defend, indemnify, and hold harmless Ace It and its owners, employees, and suppliers from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Third-Party Services

The Service relies on third-party providers for payment processing (Stripe), hosting, and bot protection. Your use of those services is subject to their own terms. We are not responsible for the availability or behaviour of third-party services, but we choose reputable providers and take reasonable steps to integrate them securely. 16. Changes to the Service and to These Terms

We may add, modify, or remove features of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or via an in-product notice. Your continued use of the Service after the effective date of the change constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and cancel any active subscription.

17. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. You and Ace It agree to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute not subject to mandatory arbitration or small-claims procedure, except that each party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.

Nothing in this section overrides mandatory consumer-protection rights available to you in your country of residence.

18. Export Controls and Sanctions

You represent that you are not located in, and are not a national or resident of, any country subject to a comprehensive embargo, and that you are not on any government list of restricted parties. You agree not to use the Service in violation of applicable export control or sanctions laws.

19. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labour disputes, government action, internet or power outages, or failures of third-party providers.

20. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ace It regarding the Service and supersede any prior agreements.
• Severability: If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• No agency: Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship.
• Headings: Section headings are for convenience only and have no legal effect.
